1. Parties and agreement

These Terms of Service (the "Terms") govern the use of the ironwire service (the "Service"), operated by Portfoliobox Stockholm AB, a company registered in Sweden ("Portfoliobox", "we", "us"). By creating an account you enter into a binding agreement with Portfoliobox on these Terms. If you use the Service on behalf of a legal entity, you represent that you are authorised to bind that entity, and "you" refers to that entity.

The Data Processing Agreement and the Privacy Policy are incorporated into these Terms by reference. The Data Processing Agreement applies to the extent you process personal data on the Service.

2. The Service

The Service provides virtual machines for hosting. Each machine is a virtualised computing environment under your control; you are responsible for the software you run on it and the content you store on it. The Service's particular features and tooling may be added, changed, or withdrawn over time without amendment of these Terms, provided the core service — virtual machines for hosting — remains.

3. Accounts and SSH keys

Your account is identified by your SSH public key(s). You are responsible for safeguarding the corresponding private keys; any action performed with a key linked to your account is attributed to you. You must notify us without undue delay at root@ironwire.sh if you believe a key has been compromised. Account handles are unique, may not impersonate others, and cannot be changed after registration.

You must accept these Terms and acknowledge the Privacy Policy when creating an account. The version accepted and the time of acceptance are recorded with your account.

4. Acceptable use

You may not use the Service to:

We may suspend or terminate machines or accounts that violate this section. The Service runs on infrastructure leased from an upstream provider whose terms bind us; we act on abuse reports received from that provider or from third parties, and may suspend the affected machine immediately, without prior notice, where the report concerns illegal content or activity or a threat to the network. Where reasonably practicable we will notify you before or promptly after taking such action.

You indemnify Portfoliobox against all claims, damages, and costs asserted by third parties, including our upstream provider, arising from your breach of this section.

5. Resources and availability

Computing resources are provided from a shared pool subject to the quotas of your plan. The Service is provided without a guaranteed service level. Scheduled maintenance and unscheduled interruptions may occur. You are responsible for maintaining backups of any data you cannot afford to lose; machines and their contents may be irretrievably lost in the event of hardware failure.

6. Fees and payment

The Service is offered on a paid subscription, billed monthly in advance through our payment provider. A subscription is sold in units; the resources each unit entitles are stated on the pricing page. Subscriptions renew automatically until cancelled. Cancelling takes effect at the end of the period already paid for; we do not refund the remainder of a period, and no automatic refunds are issued. If payment fails, the payment provider retries on its normal schedule; if those retries are exhausted, the subscription ends and the account lapses. When an account lapses, its machines are suspended and its data is retained for thirty days, after which it is permanently deleted. Prices are quoted in euro and are exclusive of VAT, which is calculated and added at checkout at the rate applicable to your location. Business customers in the EU who supply a valid VAT identification number are invoiced under the reverse charge mechanism.

7. Your content

You retain all rights to the data, software, and other content you store or run on the Service. You grant Portfoliobox only the limited rights necessary to operate the Service, including storing, transmitting, and backing up your content. We do not access the contents of your machines except as necessary to operate the Service, to investigate suspected violations of section 4 or threats to the security of the Service, to comply with a legal obligation, or with your consent.

8. Termination

You may delete your machines and account at any time. We may terminate the agreement with thirty (30) days' notice, and may suspend or terminate it with immediate effect in the event of a material breach of these Terms, a legal requirement, or non-payment. Upon termination, your machines and stored data are deleted in accordance with the Privacy Policy and the Data Processing Agreement.

9. Warranties and liability

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the extent permitted by applicable law. Portfoliobox is not liable for indirect or consequential damage, including loss of profit, loss of data, or business interruption, except in cases of intent or gross negligence. Portfoliobox's aggregate liability under this agreement is limited to the fees you paid for the Service during the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under mandatory law, including mandatory consumer-protection law where it applies.

10. Changes to these Terms

We may amend these Terms. Material changes are announced through the Service with reasonable advance notice. The current version and its date are always shown at the top of this page. Continued use of the Service after a change takes effect constitutes acceptance of the amended Terms; if you do not accept them, you must stop using the Service and may terminate your account.

11. Governing law and disputes

These Terms are governed by the laws of Sweden, without regard to its conflict-of-law rules. Disputes arising out of or in connection with these Terms shall be resolved by the Stockholm District Court as court of first instance, unless mandatory law provides a different venue for consumers.
